1. Eligibility

3. Use License

Subject to your compliance with these Terms, Cthulhu Entertainment grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and play our games on compatible devices for personal entertainment
• Access game updates, patches, and downloadable content associated with your purchases

This license does not include the right to:

• Modify, reverse engineer, decompile, or disassemble any part of our Services
• Copy, redistribute, or sublicense our games or content
• Use our Services for any commercial purpose without prior written consent
• Remove or alter any proprietary notices, labels, or marks
• Use automated systems (bots, scrapers, etc.) to access our Services

4. Prohibited Conduct

When using our Services, you agree not to:

• Violate any applicable local, state, national, or international law or regulation
• Harass, bully, threaten, intimidate, or harm other users
• Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software designed to modify or interfere with our games

• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems, servers, or networks
• Interfere with or disrupt the integrity or performance of our Services
• Engage in fraudulent activity, including chargebacks or payment fraud
• Buy, sell, or trade accounts, in-game items, or virtual currency outside of officially supported channels
• Use our Services to distribute spam, unsolicited promotions, or advertisements
• Collect or harvest personal information from other users without consent
• Post or transmit content that is unlawful, defamatory, obscene, hateful, or otherwise objectionable

We reserve the right to investigate and take appropriate action against anyone who violates these prohibitions, including removing content, suspending accounts, and reporting conduct to law enforcement.

5. Intellectual Property

All content, features, and functionality of our Services — including but not limited to text, graphics, logos, icons, images, audio clips, video, software, game assets, character designs, storylines, and the overall look and feel — are owned by Cthulhu Entertainment or our licensors and are protected by United States and international intellectual property laws.

Our trademarks and trade dress include:

• The Cthulhu Entertainment name and logo
• Astro Idle and all related game titles, logos, and artwork
• Any slogans, taglines, and branding associated with our Services

Fan Content & Content Creators

We encourage our community to create fan art, videos, streams, reviews, and other creative works based on our games, provided that you:

• Do not claim official affiliation with Cthulhu Entertainment
• Do not sell fan content for profit without our written permission
• Credit Cthulhu Entertainment as the source material
• Do not use fan content to promote hateful, discriminatory, or harmful messaging

6. User-Generated Content

Our Services may allow you to submit, post, or transmit content ("User Content"). By submitting User Content, you:

• Grant Cthulhu Entertainment a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with our Services
• Represent that you own or have the necessary rights to submit the content
• Agree that your User Content does not violate the rights of any third party
• Understand that we are not obligated to use, display, or compensate you for User Content

7. Game-Specific Terms

Astro Idle

Astro Idle is currently in development. Access to early builds, beta versions, or pre-release content may be offered at our discretion. By participating in early access or beta testing, you acknowledge that:

• The game is a work in progress and may contain bugs, errors, or incomplete features
• Game progress, save data, or virtual items may be reset or wiped during development
• Features, mechanics, and content are subject to change without notice
• Your feedback may be used to improve the game without compensation
• Early access does not guarantee any specific features, release dates, or final product

Virtual Items & In-Game Currency

Our games may include virtual items, currencies, or other digital goods. These virtual items have no real-world monetary value and are licensed to you, not sold. We reserve the right to manage, regulate, modify, or remove virtual items at any time.

Online Features & Multiplayer

If our games include online or multiplayer features, you agree to abide by our community standards and treat other players with respect. Toxic behavior, cheating, and griefing may result in temporary or permanent suspension from online features.

8. Purchases & Payments

Purchases of our games and related content are processed through third-party platforms (e.g., Steam, Epic Games Store). All transactions are subject to the terms of the respective platform.

• All prices are listed in the applicable currency and may include taxes where required
• We reserve the right to change pricing at any time without prior notice
• Refund policies are governed by the platform through which the purchase was made
• Promotional pricing and discounts are offered at our sole discretion

We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.

10. Disclaimers

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• Our Services will be uninterrupted, timely, secure, or error-free
• The results obtained from our Services will be accurate or reliable
• Any defects or errors in our Services will be corrected
• Our Services will be free of viruses or other harmful components
• Our games will be compatible with all hardware or software configurations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CTHULHU ENTERTAINMENT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damage to hardware, software, or data resulting from use of our Services
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on our Services

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless Cthulhu Entertainment from and against any claims, liabilities, damages, losses, costs, or fees arising out of:

• Your use of our Services
• Your User Content
• Your violation of any rights of a third party

13. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your right to use our Services will immediately cease
• We may delete your account and associated data
• Any licenses granted to you under these Terms will be revoked
• Provisions that by their nature should survive termination will survive

You may terminate your relationship with us at any time by ceasing to use our Services.

14. Governing Law & Disputes

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms shall be resolved through:

• Informal Resolution: Before filing any formal proceedings, you agree to contact us at r.pdreher@cthulhuentertainment.com and attempt to resolve the dispute informally for at least 30 days.
• Binding Arbitration: If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA) in the State of Florida.
• Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action or representative proceeding.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Post a prominent notice on our website
• Provide at least 30 days' notice before significant changes take effect
• Notify registered users via email when possible
